By accessing and using MiniFigureAI.com ("the Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, discontinue use immediately.

1. Acceptance of Terms

Your continued use of the Website constitutes your acceptance of these Terms and any future updates.

2. Eligibility & Minimum Age

You must be at least 13 years old to use the Website. We do not knowingly permit anyone under 13 to create an account; if you are a parent or guardian and believe your child under 13 has provided us information, contact support@minifigureai.com and we will delete it. If you are between 13 and 17, you may use the Website only with the consent of a parent or legal guardian. By creating an account, you represent that you meet these requirements. We do not independently verify age.

3. User Conduct

You agree to use the Website only for lawful purposes. You are responsible for any content you upload and must not submit content that is unlawful, inappropriate, or infringes the rights of others.

4. Intellectual Property

All content on the Website — including designs, text, graphics, logos, and software — is the property of MiniFigureAI.com or its licensors and is protected by applicable intellectual-property laws. You are granted a limited, non-exclusive license to access and use the Website for personal, non-commercial purposes only.

You retain ownership of photos you upload. By uploading, you grant MiniFigureAI a limited license to process, store, and display your content for the purpose of providing the service.

5. AI-Generated Content

AI-generated avatars are produced by third-party artificial intelligence services. By using our service, you acknowledge and agree that:

  • AI-generated images may not be accurate representations and may contain errors, artifacts, or unintended content.
  • MiniFigureAI assumes no liability for the content, quality, accuracy, or appropriateness of AI-generated images.
  • Your photos are transmitted to third-party AI providers (such as OpenAI) for processing. We do not control how these providers handle your data beyond our contractual agreements with them.
  • You are solely responsible for how you use, share, or distribute AI-generated images.
  • AI-generated images may be subject to the terms and policies of the underlying AI provider.

6. Acceptable Use Policy

Users must comply with the Photo Content Policy described in our Privacy Policy. MiniFigureAI reserves the right to:

  • Remove any content that violates these Terms without notice.
  • Suspend or terminate accounts that violate these Terms.
  • Report illegal content to appropriate law enforcement authorities.
  • Cooperate with law enforcement investigations.

Users must not:

  • Upload content they do not have rights to.
  • Use the service to create deepfakes or misleading content intended to deceive.
  • Use the service for any illegal purpose.
  • Attempt to reverse-engineer, scrape, or abuse our systems.
  • Use automated tools to mass-generate content.
  • Circumvent rate limits or credit restrictions.

7. Account Suspension & Termination

We may suspend or terminate your account at any time for violation of these Terms.

  • Upon suspension: access to the service is immediately revoked.
  • Upon termination: all account data, credits, photos, and avatars are permanently deleted.
  • Purchased credits are non-refundable after use. Unused credits on accounts terminated due to policy violations are forfeited.
  • You may appeal a suspension by contacting support@minifigureai.com.

8. Disclaimer of Warranties

The Website and its services — including all AI-generated content — are provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

In no event shall MiniFigureAI.com, its affiliates, its third-party AI providers, or their respective directors, officers, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Website, its services, or any AI-generated content.

10. Third-Party Services

Our service relies on third-party providers for AI processing, payment processing, and other functionality. We are not responsible for the content, practices, or availability of third-party services, and you agree that we are not liable for any loss or damage arising from their use.

11. Email & Marketing Communications

By creating an account, you agree to receive transactional and service-related emails from MiniFigureAI — including account notifications, security alerts, receipts, and replies to your support requests. These emails are necessary for the operation of your account and cannot be opted out of while your account is active.

We may also send marketing emails — promotions, new feature announcements, holiday-themed offers, and product updates. You consent to receive these by creating an account, and you may opt out at any time by:

  • Clicking the "unsubscribe" link in the footer of any marketing email.
  • Using the one-click unsubscribe in supported email clients (Gmail, Apple Mail).
  • Emailing support@minifigureai.com with the subject "unsubscribe".

Opt-outs are honored immediately upon receipt. Opting out of marketing does not affect your receipt of transactional or service-related emails. A parent or legal guardian may opt out of marketing on behalf of a minor at any time using the methods above.
